Instructor Terms & Conditions
These Terms & Conditions apply to driving lessons, learner onboarding, lesson bookings, payments, communication and related services provided by the learner's instructor.
1. Lessons
- Driving lessons are provided by the learner's instructor.
- Lessons will begin and end at the agreed time and location wherever reasonably possible.
- The instructor may alter lesson routes and content to suit the learner's ability, traffic conditions, weather and safety requirements.
- Time spent discussing progress, planning the lesson, completing records or carrying out vehicle checks forms part of the booked lesson time.
2. Eligibility to Drive
- Learners must hold a valid UK provisional or full driving licence and must present it upon request.
- Learners must be legally entitled to drive in the United Kingdom.
- The instructor may refuse a lesson if they believe the learner is unfit to drive due to alcohol, drugs, medication, illness, tiredness, eyesight concerns or any other safety issue.
- Learners must inform the instructor of any medical condition, injury, medication or change in circumstances that may affect their ability to drive safely.
3. Lesson Bookings
- Lessons are booked by mutual agreement between the learner and instructor.
- Lesson times are not guaranteed until confirmed by the instructor.
- Recurring bookings may be amended due to holidays, illness, vehicle maintenance, driving tests, traffic conditions or other circumstances beyond the instructor's reasonable control.
4. Punctuality
- Learners should be ready at the agreed collection point and time.
- If a learner is late, the lesson may still finish at the scheduled time and the full lesson fee may still apply.
- If the instructor is delayed, they will make reasonable efforts to inform the learner and either extend the lesson where possible or make up the lost time by agreement.
5. Cancellations
- A minimum of 48 hours' notice is required to cancel or rearrange a lesson.
- Lessons cancelled with less than 48 hours' notice may be charged in full.
- Failure to attend a booked lesson without notice may be charged at the full lesson rate.
- The instructor may waive cancellation charges at their discretion in genuine emergencies.
- If a lesson is cancelled by the instructor due to illness, vehicle breakdown, severe weather, family emergency or circumstances beyond reasonable control, an alternative lesson will be offered as soon as reasonably possible. No additional compensation will be payable.
6. Payments, Credits and Refunds
- Payment for lessons must be made in advance unless otherwise agreed.
- Lesson credits purchased from the instructor remain valid in accordance with the instructor's pricing and refund policy unless otherwise agreed in writing.
- Credits are non-transferable.
- Refund requests for unused lesson credits must be made in writing.
- Any lessons already taken will be charged at the standard lesson rate before any remaining balance is calculated.
- Refunds will normally be processed within 14 days of agreement.
7. Practical Driving Tests
- Learners are responsible for booking their own theory and practical driving tests unless otherwise agreed.
- Use of the instructor's vehicle for a practical driving test is subject to the learner reaching a safe and consistent test standard.
- The instructor reserves the right to withdraw use of the vehicle if they believe the learner is not ready, is unsafe, has not followed advice, or if there are other safety concerns.
- The instructor's decision regarding test readiness is final and is made in the interests of safety.
- Driving test fees paid to the DVSA are separate from lesson fees and are subject to DVSA rules.
8. Instructor Vehicle and Behaviour
- Learners must treat the instructor's vehicle with care and respect.
- Smoking, vaping, alcohol and illegal substances are not permitted in the vehicle.
- Mobile phones must not be used while driving unless permitted by law and instructed by the instructor.
- The instructor may stop or end a lesson immediately if the learner's behaviour compromises safety.
9. Dashcam and Lesson Recording
- For safety, security, training and insurance purposes, lessons may be recorded using vehicle-mounted dash cameras.
- Recordings may be retained where necessary for incident investigation, complaint resolution, insurance claims, legal compliance or training.
- Recordings will not be published for marketing purposes without separate consent.
10. Lesson Records and Progress Tracking
- The instructor and SimpL OS may maintain learner records, training notes, progress reports, lesson summaries and learning objectives.
- These records are used to support learner development, improve training quality and manage bookings, payments and communication.
- Learners may request access to their training records.
11. Electronic Communications
- By registering through SimpL OS, learners agree to receive service-related communications about lessons, bookings, payments, progress, reminders, tests and important account updates.
- These communications may be sent by SMS, email, push notification or other electronic means.
- Service messages are separate from marketing messages.
12. Data Protection
- Personal information is collected for the purpose of providing driving tuition and related services.
- Personal information will be processed in accordance with applicable UK data protection legislation.

13. Liability
- Every reasonable effort is made to provide safe, professional driving tuition.
- Learners remain responsible for complying with road traffic laws and following safety instructions from the instructor.
- Neither the instructor nor SimpL OS shall be liable for losses arising from cancelled lessons, driving test cancellations, severe weather, vehicle breakdowns, traffic disruption or circumstances beyond reasonable control.
14. Digital Acceptance
- Acceptance of these Terms & Conditions through the SimpL OS platform shall be treated as confirmation that the learner has read, understood and accepted them.
- Digital acceptance may be recorded with a timestamp, version number and IP address for audit purposes.
